Police: Drugs a factor in crash

BENNINGTON — A North Bennington man is facing felony charges after police said they believed he had been using a depressant drug before causing a crash in Bennington.

David J. Corcuera, 34, was arraigned last week on a felony charge of driving under the influence of a drug, a felony charge of refusing to submit to a blood test and a misdemeanor charge of grossly negligent driving.

In an affidavit, Officer John Behan of the Bennington Police Department said he was dispatched to investigate a two-vehicle crash at the intersection of North Bennington Road and Hannaford Shopping Plaza around 7:50 a.m. July 14. There were no reported injuries.

Behan said one driver, Helen Morey, 71, said she was driving east on North Bennington Road and had come to a stop at a traffic light when the other car, driven by Corcuera, hit her in the back. A witness told Behan that what she had seen while walking on North Bennington Road supported Morey’s story.

When Behan spoke to Corcuera, he noticed signs of impairment, according to the affidavit. Corcuera told Behan he did not take any drugs for which he did not have a prescription but said he is part of a methadone program because of a previous drug problem.

Corcuera was taken to the Bennington police station where Cpl. Andy Hunt, a Bennington police officer who is a nationally certified drug recognition expert, said he believed Corcuera was under the influence of a central nervous system depressant drug.

Corcuera declined to provide a blood sample.

According to court records, Corcuera has been previously convicted of driving under the influence of substances in July 2006 in Vermont and January 2009 in New York.
