    Man faces charge

    in choking incident

    BENNINGTON — A local man is facing a felony assault charge after police said he choked a man in Bennington.

    Miguel E. Maisonet, 34, of Bennington pleaded innocent Monday in Bennington criminal court to a felony count of aggravated assault and misdemeanor charges of simple assault and disorderly conduct.

    Officer David Faden of the Bennington Police Department said police responded to a report of a fight June 22 around 9 p.m. on Depot Street.

    Joseph and Kristie Pratt told police they were walking on the corner of Depot and River streets when they came across Maisonet petting a dog. Kristie Pratt told police she said “excuse me” to get around Maisonet but he became agitated and yelled at her, spit in her face and punched her, according to Faden’s affidavit.

    Joseph Pratt said Maisonet then hit him and pushed him up against a metal fence and choked him, the affidavit said.

    Joseph Pratt said he was able to get away, but that when Maisonet was choking him he couldn’t breathe, police said.

    Another witness, who didn’t know any of the people involved, gave police a similar statement.

    Faden said he had “many past professional encounters” with Maisonet and that he was unusually aggressive June 22. The officer said Maisonet threatened his life and urinated on the floor of the holding cell at the Bennington Police Department.

    Maisonet was released without bail but ordered to check in daily at the Bennington Police Department and not to have contact with the Pratts.
