Police say it's the second such offense 42-year-old John Partch is accused of. He's at the Marble Valley Regional Correctional Facility in Rutland.

Details of the alleged assault have not been released, but police say the incident happened on April 17, 2012, and was investigated.

Calls to the police for further information weren't immediately returned Friday morning.
